Provincial Offences

Provincial Offences, also known as Regulatory Offences, are offences which do not result in a criminal record. However, there are still serious consequences with being charged such as hefty fines, demerit points, and potential jail time.

Provincial Offences include charges under the:

These offences are prosecuted and treated by the courts in a similar manner as criminal offences. You have a right to full disclosure of the Crown’s case against you, and the Crown still requires to establish guilt on the standard of proof beyond a reasonable doubt. Although these types of offences are prosecuted in a similar manner, it is not entirely the same. The Crown is not required to prove the intention to commit the offence in question, and negligence is often the only proof needed to be convicted and receive a fine or other type of penalty. Often, a good defence for these types of offences involve showing that you exercised the proper due diligence at the time of the alleged offence with the goal of receiving as lenient of a penalty as possible.
