Core Principles

Within criminal proceedings, individuals are considered innocent until proven guilty. This is called the presumption of innocence. In order to be convicted of a criminal offence, the prosecution (representing the Crown) bears the burden of proof in that the Crown must prove the accused’s guilt beyond a reasonable doubt. Everyone has a right to a fair trial, which includes having legal representation.

Classification of Offences

Summary Offences are considered to be the less severe type of offences where the maximum sentence is two years less a day incarceration and/or a $5,000 fine. Paralegals are permitted to provide representation in most summary matters.

Hybrid Offences are offences in which the Crown needs to elect whether they are proceeding by indictable or summary conviction. If the Crown wishes to proceed by way of summary conviction, a paralegal may be able to represent someone accused of a hybrid offence.

Indictable Offences are the most severe types of offences and involve the most formal procedures. Paralegals are not permitted to represent those accused of a straight indictable offence. Examples of an indictable offence include murder, breaking and entering into a dwelling home, and aggravated sexual assault.
